Well, when you include a thread to kill someone in a poem, that kind of takes away someone's freedom of speech...IMO...

Free Speach is more toward not agreeing with the government. What your doing right now. Not saying your going to kill your entire class. I think they have all the power in the world to get this insane kid under control.

but who says he is insane? He sounds more pretentious to me. Maybe he was just releasing some bad feelings. Who hasen't played halo to blow off steam? Should we all be arrested?
How does playing Halo compare to a threat (that is what it is) to classmates?

Why would he write something like that? Why? After Columbine, is that an expression?

I have to agree - we all have freedom to do whatever we want as long as it doesn't infringe upon others' rights. If someone says they're going to kill people (or actually does so), it messes with those people's rights, so that's not allowable.

I don't see any direct threats in the example they gave him. Lots of metal bands say this kind of stuff in their music, talking about death and destruction of their peers but they don't actually mean it. Like the poem said, the kid explained that he wasn't going to bring guns to school but that he "could" and he had the potential to do so. It's not saying that he would, obviously something was troubling him enough that he might be pushed to the edge and do this. It doesn't mean that he would immediately do it, it could be prevented instead of trying the kid with criminal injustice.

Freedom Of speach is not there to protect the speach you like, it is there to protect the speach you hate. I see no threat. This kid was just expressing himself. It's not like he actually did it. If everyone was arrested for saying "I'm going to kill you" then everyone in America would be in jail.

ITs not like he said "I'm going to kill you all tommorow! Kill you good! With my semi! The gun not the truck"

He just took the "I'm going to kill you" point to a different degree, and he still wasn't serious about it.

I agree fullheartly. In Junior High I got bullied like friggen hell. While the teachers did nothing, and i mean NOTHING! to stop them.
I got counsleing but all they really did was say, "Just ingore them" No matter what TV adds say, ingoreing does not work!!!! they just get worse and worse and worse. This one guy chucked paper balls at me, so i was like, "ingore him, and he shall stop" So he started to lick, and i mean lick the paper balls, its kinda hard to ingore that!!!
I'm so glad thats behind me now. :g04:

But I do not think that what this kid did was anywhere near conspirisy, and any sane judge would agree with me, oh and Shnag, the best way to beat that is to flip out ninja style on one of them, then they don't bother you anymore.
Okay, the issue is this: WHY in the hell would you even TALK about bringing guns to school? Killing classmates? That is NOT expressing yourself. Do you know what "expressing yourself" means? Well, let me tell you, it doesn't involve writing poems about deaths on past issues (that being kids taking guns to school to massacre students). Like that prosecutor said -- you have to take the poem into literal terms, not read it as it isn't a threat. If I wrote something saying I was going to attack a building like the 9/11 incident, I'd go to jail, no doubt...and Im sure you wouldn't say, "He was just expressing himself." ...
Expressing hate through words is one thing, but expressing hate through words of threat is another.

How do you know he was threating? He did say I can be the next kid to bring guns to kill students at school. He could be mearly commenting on how lax the schools system is, or how much he hates everyone. Myself, well I can think of more than a few times that I would have liked to bring my axe to school and sink it into a few kids brains, but does that make me a criminal? I think not. People are allowed to think what they want to think, and write what they want to write, as long as no one is harmed. This kid was possibly just honestly expressing himself to let out some bad feelings, and there is nothing that I can see that is wrong with that.
So, if I told you I knew John address, and I said, "Hey, I could be the one who breaks into your house and maims your family," then you wouldn't feel that is a threat? Damn, you must have no intimidation towards danger, even if it could or would kill you.

The point there trying to prove is that you should not be writing about that stuff. Todays world is a lot more different than when they first wrote the first amendment. It is alot more serious and you should know not to write stuff like that. Why would you want to write something like that to blow off steam anyway? Thats just stupid. When I'm mad I just chill out for a little I dont go writing death threats. BTW Im back -.-

sucks for that kid. At all schools in Georgia you have no rights such as free speech. I feel like a ****ing communist here under stalin's regime or more like our principle Tesh's Regime :D. My friend almost got expelled for defending himself when a custodian attacked him, the dumbass administrators say that he should have reported it instead. I mean WTF while a custodian is beating your brains are you gonna be like "could you stop the head bashing into the wall for a minute so can tell an administrator on you?"
Instead they locked him in a the closet of trailer 300 for the last 6 weeks of school.
